EPA climate rule still months from finalized; Agency defends against states' challenges

  • The Environmental Protection Agency’s Clean Power Plan could take two more months to become official, The Hill reports, citing the Office of Management and Budget’s ongoing review. That schedule also delays attempts to block the rule since it cannot be formally challenged in court until the rule is officially published in the Federal Register.
  • “The states face no irreparable harm from the deadlines proposed in the Clean Power Plan,” Bloomberg writes of court papers filed Monday by the federal government. From the court filing:

    “Although the Rule instructs the states to submit plans to implement those standards, and imposes a September 2016 deadline for the submission of a state plan, a state may obtain a two-year extension of that deadline by submitting, by that same date, a minimal initial submittal.”
